Supreme Court decides in Favour of our client being sued By Liquidators under s588F of Corporations Act

 

Our clients (The Defendants) were personally sued for over $350,000 by Liquidators of a company that our clients were the directors of. The claim was based on an assertion that the defendants had carried out an uncommercial transaction due to transfer of  within the meaning of S588FB of the Corporations Act (The Act) as well as breach of their director duties.

 

It was argued on behalf of our clients that the transactions carried out were not in contravention of the Act due to a simple fact that the assets were not owned by the company. It was further argued that in order to establish that these transactions were voidable, uncommercial and unreasonable it must first be established that the assets in fact belonged to the company in liquidation.

 

His Honour Justicee Ashley Black of the Supreme Court ruled in our clients’ favour noting that the transactions that took place were in fact not in contravention of the Act as alleged and that no duties were breached by the company’s director.

 

An order for costs on an indemnity basis was also made against the Liquidators.

Following an exhaustive 12-week criminal jury trial in the District Court of NSW, spanning four months from May 15, 2023, until August 14, 2023, the jury unanimously returned a “Not Guilty” verdict.

Client charged with Common Assault (Domestic Violence Related) and Affray gets his matter dismissed

 

Our client, a 62 year old man was charged with with Common Assault against his son and Affray. Our client admitted assaulting the son but only because the son had disrespected, abused and hit him initially.

 

In March 2022’The matter was brought before Fairfield Local Court in for sentence. Our lawyers made competent submissions for the matter to be dismissed under s10(1)(a) of Crimes (Sentencing and Procedure) Act.

Client charged with sexual offences granted bail by the Local Court

 

In November 2020, a man was charged with multiple serious offences like sexually touching a child under 10 years of age and denied bail by NSW Police.

 

Our lawyers appeared before Mt Druitt Local Court and made competent submissions to convince the court that the client was not a risk to the community and public at large. The client was granted bail with strict conditions.

Client charged with assault occasioning actual bodily harm and intentionally choking without consent acquitted by Local Court in Campbelltown

 

In October 2019, a 28 year old man was charged with assault occasioning actual bodily harm, intentionally choking and common assault for allegations from his ex partner. The man always maintained his plea of not guilty and the matter was brought before Campbelltown Local Court for a hearing.

 

During Cross Examination of the victim, it was revealed that she had initiated the physical assault causing our client immense pain. Our client in return retaliated in self defence to get away from the victim.

 

The court accepted our argument on behalf of our client and dismissed the matter on the basis of self defence.

Divorce granted to a client living in the United States of America

 

A client approached Dot Legal to file a divorce application in the Federal Circuit and Family Court of Australia.

 

The client lived overseas in the USA and it was quite difficult obtaining instructions due to the time difference. Nonetheless, our lawyers worked hard and ensured that proper instructions were obtained and an application of divorce was filed.

 

In order to establish jurisdiction, since the client was overseas and the address of the respondent was unknown, our lawyers filed an affidavit clarifying jurisdiction. The Court was ruled that jurisdiction was established and effectively divorce was granted to our client.

Client successful in restricting lodgement of any further caveats on the property

 

A client instructed Dot Legal to deal with a recurring caveat on was lodged on her property despite being once withdrawn previously.

 

Our lawyers approached the Land Registry of New South Wales and sent written submissions asking for restrictions of any further caveats under s74O of the Real Property Act 1900.

 

The Land Registry of New South Wales accepted our submissions and restricted the other party from lodging any further caveats on our client’s property.

Client successful in being paid $100,000 in damages for breach of contract

 

A client instructed Dot Legal to act for the conveyance of their purchase of property. The other side (being the vendor) signed and cooled off on the contract of sale of land decided not to proceed with the sale.

 

Our lawyers successfully negotiated to mutually allow the contract to be rescinded on the basis that our client was paid $100,000 in full and final settlement of the matter.
